KOEK, (hereinafter also referred to as “Company”, “we”, “our” or “us”) operates https://koek.sc (“Website”, “Platform”) and advertises travel and tour or related services to our clients (“Services”). These Terms and Conditions (“Terms”) govern the Services and use of the Services provided by the Company. By accessing and/or otherwise using the Services in any manner, you, therefore, agree that you have read and accepted these Terms. We reserve the right to modify these Terms, without notice, at any time. You understand that your continued use of the Services after these Terms have been modified constitutes your acceptance of these Terms as amended.

Regularly checking and reviewing this page ensures that you are updated on the terms and conditions governing your use of the Services.

If we believe that the modifications are material, we will notify you of the changes by posting a notice on our Website, or emailing you at the email address provided to us by you, as we may deem appropriate. What constitutes a material change will be determined by us, at our sole and absolute discretion.

Agreement to Terms

By using our Services, you agree to be bound by these Terms. If you don’t agree to be bound by these Terms, do not use the Services. If you are accessing and using the Services on behalf of a Company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that Company or other legal entity to these Terms.

Accuracy, Completeness, and Timeliness of Information

We are not responsible if the information made available on this Website is not accurate, complete, or current. The material on this Website is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information.

We reserve the right to modify the contents of this Website at any time, but we have no obligation to update any information on our Website. You agree that it is your responsibility to monitor changes to our Website.

Modifications in Service and Price

Prices for the Services listed on our website are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Services.

If you purchase any services from us, you agree to pay the full amount for the service, and any applicable taxes, in a timely manner. The customer is responsible for any applicable taxes or duties associated with the travel and tour services provided by our business.

Modifications to existing bookings (such as rescheduling) are subject to availability and must be requested through the platform’s customer support at least 24 hours before the scheduled time. If modifications to an existing booking is not feasible, and the request has been made at least 24 hours before the scheduled time, the customer can request a full refund of the bookable products, subject to bank transaction fees.

Booking Requirements

All Services are confirmed only upon receipt of payment. When you book through us, a deposit of 15% of the total booking is required. The remaining balance is to be paid directly to the supplier on the day of the experience. The payment method for settling the balance with the supplier may vary, depending on the supplier’s preferences. We advise you to review the payment breakdown on each product page to ensure that you understand the payment method accepted by the supplier. Suppliers are required to clearly disclose any additional fees, such as national park entry charges, in their listings.

We handle the processing of your deposit payment securely through Stripe. Stripe is a trusted payment gateway that utilises advanced encryption methods and complies with PCI DSS (Payment Card Industry Data Security Standard), ensuring that your payment information remains secure and protected from unauthorised access throughout the transaction process.

Deposit payments are not processed until the supplier has confirmed availability. All Services are only confirmed once availability has been verified by the supplier, the deposit payment has been processed, and you have received a confirmation email detailing the successful booking of your chosen Services. This process can take up to 12 hours after you have submitted your booking order on the Platform’s checkout page.

Customers are responsible for ensuring their contact details are accurate to facilitate timely communication and updates. For any general queries related to cancellations, refunds, or booking adjustments, please contact us at info@koek.sc.

Cancellations and Refunds

Customer Initiated Cancellations

Cancellations can be made up to 24 hours in advance of the scheduled Services to qualify for a full refund. Full refunds are provided for such cancellations subject to any bank transaction fees.

To receive a full refund, please email us at info@koek.sc, including:

-Your name.

-Order number.

-The name of the bookable product you wish to cancel (if you have booked more than one product.)

All cancellation requests must be submitted by 12:00 AM on the day prior to your booking start date. Full refunds will be issued for eligible cancellations, less any applicable bank transaction fees.

Platform Initiated Cancellations

Cancellations from the supplier side may occur due to factors such as, but not limited to:

-Poor weather conditions that could affect safety.

-Insufficient group participants for group activities.

-Accidental double booking of a car rental

In such cases, the customer will have two options:

-Rescheduling: The customer can, subject to availability, choose an alternative experience or another available booking.

-Full Refund: If the customer is not satisfied with the rescheduling option, they are entitled to a full refund, subject to any bank transaction fees.

Refunds may take up to 5-10 working days to process, depending on the customer’s bank or card issuer.

Customer Reviews

Our review system is intended to provide insights into the supplier’s overall reputation, as well as to evaluate individual products they offer. This approach allows customers to gain a comprehensive understanding of a supplier’s history and reliability.

Reviews may only be submitted if you have purchased and fulfilled a bookable product. Each review is subject to an approval process to ensure it adheres to our safety and content guidelines, which include but are not limited to prohibiting inflammatory, racist, threatening content, inappropriate language, personal attacks, misleading information, or content that is irrelevant to the booked product or service. This process ensures the accuracy, quality, and integrity of feedback on our platform.

Typically, reviews will appear on our website within 24 to 48 hours; however, this period may be extended if further examination of the content is necessary. Once published, reviews remain on the site indefinitely unless they are found to breach our publication criteria. Reviews submitted in exchange for personal benefits, such as gifts or money, will be removed. While suppliers may encourage customers to leave reviews, they are prohibited from offering incentives for doing so. If you encounter such offers, we encourage you to notify us.

Once a review has been submitted, it cannot be altered. Reviews may also appear on our partner sites or in promotional materials.

Promotional Offers and Vouchers

Promotional offers, discount codes, or vouchers cannot be used in conjunction with other promotions. For promotional offers that involve a deposit refund, the customer will receive the full deposit amount agreed upon, minus any applicable bank transaction fees. Refunds may take up to 5-10 working days to process, depending on the customer’s bank or card issuer.

The Refundable Deposit scheme provides a 15% discount on all excursions, tours, and car rentals booked through the KOEK platform to guests staying at select small accommodation establishments membered with the Seychelles Small Hotels and Establishments Association (SSHEA). To qualify, bookings must be made in advance of the accommodation check-in date.

To use this scheme, guests must enter the name of the participating accommodation establishment on the KOEK checkout page. The deposit paid to secure the booking(s) will then be automatically refunded on the day following the accommodation check-in or the day after the booked service begins, whichever is later.

KOEK reserves the right to modify, suspend, or terminate the Refundable Deposit scheme or any other promotional offer, discount codes or vouchers at any time, without prior notice or liability. Such changes may apply to existing or new bookings, at the Company’s sole discretion. The availability of any promotional offer is not guaranteed and is subject to change based on business, operational, or regulatory considerations.

Use of the Platform and Services

You agree to use this website only in accordance with these Terms. In the event that your unauthorised use of this website results in loss or damage to any person who then brings a claim against us, you agree to indemnify us for all losses and/or damages arising from such claim.

Platform Liability

While we strive to ensure a seamless booking process, KOEK acts solely as an intermediary platform. We do not assume liability for individual experiences, operational delays, or other circumstances that fall under the service provider’s control.

Privacy and Usage of Cookies

The Company will not intentionally disclose any personally identifying information about you to third parties, except where the Company, in good faith, believes such disclosure is necessary to comply with the law or enforce these Terms. By using the Website, you signify your acceptance of the Privacy policy.

Members signing up for the Website are opting in to receive newsletters and other special offers through emails/notifications from the Website. If you do not wish to receive these emails, you may opt out anytime by unsubscribing.

Intellectual Property Rights

All material and content on the Website, including images, illustrations, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is our property, or the property of our affiliates or content suppliers, and is protected by international intellectual property laws.

Indemnification

By using KOEK to book services, the customer agrees to indemnify and hold KOEK, its affiliates, employees, and agents harmless against any claims, damages, liabilities, losses, or expenses arising out of or in connection with:

Their participation in activities booked through the platform. Any misrepresentation of information provided by suppliers. Any breach of these booking conditions or applicable laws by the customer. Disclaimers We make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the Website or the information, materials, content, services, or related graphics contained on the Website for any purpose.

Limitation of Liability

KOEK serves as a digital marketplace and intermediary connecting customers with various tour and travel service providers. We facilitate the booking process but do not directly offer or control the activities, services, or experiences listed on our platform. The service provider (referred to as “supplier”) is solely responsible for delivering the services booked by the customer, including the safety, quality, and fulfilment of the experience. KOEK does not assume responsibility for the actual service delivered by suppliers.

KOEK is not liable for any personal injury, property damage, financial loss, or other damages arising directly or indirectly from any service or experience listed on our platform.

This includes, but is not limited to:

Accidents or injuries that occur during the booked activity or tour. Any negligence, omissions, or misconduct by the supplier or third parties. Loss of personal belongings, damage to property, or failure of suppliers to fulfil the booking as described. KOEK will not be held liable for cancellations, delays, or alterations to bookings due to unforeseen events outside of its control, including but not limited to natural disasters, extreme weather conditions, pandemics, government restrictions, strikes, or any event classified as force majeure.

Eligibility

In order to use the Platform, you need to be 18 (eighteen) years of age or older. The Platform may only be used or accessed by such persons who can enter and perform legally binding contracts under the applicable laws. The Company shall not be liable in case any false information is provided by the user, including the user’s age, and the user and/or their natural or appointed guardian alone shall be liable for the consequences as per the applicable laws. The Company disclaims all liability arising out of such unauthorised use of the Platform and any third-party liability arising out of your use of the Platform if you are a minor.

Governing Law and Jurisdiction

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in all respects in accordance with the Laws of Seychelles and shall have exclusive jurisdiction over any dispute arising under this Agreement.

Notices

Legal notices must be served on the email address provided in the ‘Contact Us’ clause. Notice will be deemed given 48 hours after the email is sent unless the sending party is notified that the email address is invalid or that the email has not been delivered. Alternatively, we may give you legal notice by mail to the address provided by you during the registration process. In such cases, notice will be deemed given three days after the date of mailing.

Legal Disputes

If a dispute arises between you and the Company, our goal is to provide you with a neutral and cost-effective means of resolving the dispute quickly. We strongly encourage you to first contact us to seek a resolution. If your dispute is not resolved by contacting us, all legal notices and formal disputes should be sent to the Company’s email address in accordance with the above-mentioned clause. We agree to consider resolving the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation in accordance with the Laws of Seychelles. The venue for alternative dispute resolution is in the Seychelles.

Removal of Doubts

Notwithstanding anything stated in this Regulation, for any unforeseen issues arising and not covered by this regulation, or in the event of differences of interpretation, the CEO of the Company may take a decision as they deem fit. The decision of the CEO shall be final.

Miscellaneous

Severability – If any provision or part-provision of this Agreement is or becomes invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of this Agreement.

Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. These Terms and Conditions and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us. Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party.

Waiver

If you breach these Terms and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms.

Amendments

Notwithstanding anything contained hereinbefore, the Company may amend and implement the Terms, whenever required, in the interest of maintaining the standard and improving user experience without any prior notice, and you shall be governed by such Terms as implemented from time to time. Please review the Terms from time to time on a regular basis since your ongoing use is subject to the Terms as amended.

Force Majeure

No party shall be liable for any delay or failure in performance due to events outside the defaulting party’s reasonable control, including without limitation acts of God, earthquake, riots, war, acts of terrorism, fire, epidemics, or delays of common carriers or other circumstances beyond its reasonable control.
